Eastern Cape couple sentenced over toddler’s abuse and murder

Eastern Cape couple, Robin Clarke and Kristen Clarke, will serve prison time following their conviction in the murder and neglect case of 19-month-old Krisley Faith Dirker, who died after suffering severe injuries in 2013.

The couple was sentenced by the Gqeberha High Court on Friday, in a disturbing case involving the prolonged abuse, deliberate neglect and death of their child.

The couple was convicted of murder and the abuse or deliberate neglect of a child.

Eastern Cape Hawks spokesperson Warrant Officer Ndiphiwe Mhlakuvana said the incident occurred on October 10, 2013.

Mhlakuvana said the severely injured toddler was admitted to Westring Medicross Hospital after sustaining catastrophic blunt force trauma to the head, accompanied by multiple injuries inflicted on various parts of her body.

“The nature and extent of the injuries painted a harrowing picture of sustained abuse and severe violence perpetrated against a defenseless child.

“Despite extensive medical intervention and efforts by healthcare practitioners to preserve her life, the toddler succumbed to her injuries a few days later, thereby transforming a horrifying abuse investigation into a murder inquiry.”

The case docket was transferred to the Gqeberha Hawks’ Serious Organised Crime Investigation unit in 2020 for further investigation and finalisation after critical investigative interventions became necessary to strengthen the evidential foundation of the matter.

Mhlakuvana said overwhelming evidence revealed that the child had been left in the care of Robin Clarke while her biological mother was at work.

The investigation was finalised, after which warrants of arrest were authorised against the accused, who were arrested in 2022.

“The investigation was subsequently entrusted to the Hawks, where meticulous and relentless pursuit of justice ultimately culminated in the successful prosecution and sentencing of the accused,” Mhlakuvana said.

Robin Clarke was sentenced to five years’ direct imprisonment for child abuse and 15 years’ direct imprisonment for murder.

“The sentences were ordered to run cumulatively, resulting in an effective twenty years direct imprisonment.”

Kristen Clarke was sentenced to five years’ direct imprisonment, wholly suspended, for child neglect, and two years of correctional supervision incorporating community service obligations.

Meanwhile, Eastern Cape Hawks provincial head Major General Mboiki Obed Ngwenya praised the investigating team and all stakeholders who contributed to securing justice in a matter that “profoundly shocked the conscience of society”.
