In documents filed with the Constitutional Court, Cholota claims she was intimidated under apartheid into working against her former boss. However, the state used a smiling photo of her taken after her interrogation to refute those allegations.

Calitz also fundamentally disputed her affidavit that she was escorted in “four blacked-out SUVs and driven to the Sheraton Hotel” where she was interrogated in Maryland, Washington about the alleged “asbestos scam”. According to Calitz’s account of that interrogation, which lasted two days and ended with Magashule’s former PA being told she was now a suspect, “at no time was Ms Cholota detained, threatened or denied her constitutional rights, nor was she subjected to ‘apartheid era tactics’, by Brigadier Gerber or I, during our interviews with her on 22 and 23 September 2021”.

“She even got to travel on her own, she met her boyfriend, we accommodated her class schedule and even picked her up and dropped her off where she needed to be. She happily asked Brigadier Gerber to take pictures of her with the [US] Ambassador [Nomaindiya Cathleen Mfeketo]which request he complied with,” he added.
